Justice Mohammed Umar ruled that the ex‑parte motion filed by the company’s lawyer, Reuben Atabo, SAN, was meritorious. He noted that the court was satisfied with the depositions and specific paragraphs of the affidavit attached to the motion.

The judge set a new hearing date for June 11, giving Malabu time to file and serve the originating summons for the requested relief.

In the suit (FHC/ABJ/CS/871/2026), Malabu named the President, the Attorney‑General of the Federation (AGF), and the Minister of Petroleum Resources as the first, second, and third respondents, respectively.

The company contends that the government divided OPL 245 into four separate assets and reassigned them to Shell Nigeria Ultra‑Deep Limited, Shell Nigeria Exploration Production Company Ltd, Nigerian Agip Exploration Company Ltd, and Nigerian National Petroleum Company (NNPC) Limited. It further alleges that this reallocation was carried out under the OPL 245 Resolution Agreement dated about March 5, without the consent of its directors.
